Fraud, Deceit, Misrepresentation:

Persons are entitled to receive compensation for their losses that resulted from the Fraud, Deceit or Misrepresentation of defendants.

There are many subtle varieties of fraud, deceit and misrepresentation, because courts require the plaintiff to plead the falsity in very specific terms. Only economic and not emotional distress damages are usually recoverable in these cases. However, at the same time, punitive damages are generally recoverable without additional proof because the fraud, etc., already involves wilful misconduct by the defendant.

Defendants foreclosed on a new hill top home under a deed of trust, claiming that they had funded a loan for $175,000.00 in part with $85,000.00 in cash payments. The $85,000.00 in cash payments were denied by plaintiffs and were economically improbable under the terms of the loan. Decision: $1,108,000.00 compensatory damages; additional punitive damages pending. Martin v. Private Investors Financing, No. BC 217022, Los Angeles Superior Court.

Defendants told a Singapore manufacturer that defendants owned the patent rights to a new technology machine that pulled inexpensive, clean water from the air, but failed to disclose that their “assignments” of those rights had admittedly been backdated several years, causing the Singapore manufacturer to renegotiate their $5,000.000.00 contract with the plaintiffs.
